Terms and Conditions

1. Who we are
ACTV8me Predictive Play (the “Service”) is operated by ACTV8ME, LLC (“ACTV8me”, “we”, “us”). By opening or using the Service you agree to these Terms and Conditions (the “Terms”). If you do not agree, do not use the Service.
2. Who may play
You must be at least 18 years old, or the age of majority where you live if that is higher, to use the Service. We may ask you to confirm your age and may suspend access if we cannot.
3. The game
The Service is a free-to-play prediction game. No purchase or payment is required to play, and none is accepted. Points, streaks, ranks and similar in-game items have no cash value, cannot be bought, sold, exchanged or redeemed for money, and are not a wager, bet or gambling product. Predictions are settled from the data feed we use at the time of settlement; a settlement is final once shown.
4. Prizes and sponsor offers
Some games may offer prizes, rewards or sponsor offers. Each is described in the game in which it appears, and its own rules, eligibility and expiry apply in addition to these Terms. Sponsor offers are provided by the sponsor, not by ACTV8me, and are subject to the sponsor’s terms. We may substitute a prize of equal or greater value where the stated prize is unavailable.
5. Your conduct
Use the Service only as it is meant to be used. Do not use bots, scripts or multiple identities, interfere with the Service or its data, or attempt to gain an unfair advantage. We may remove points, void results or suspend access where we believe this has happened.
6. Our content and third-party data
The Service, its design, software and content are owned by ACTV8me or its licensors and are protected by intellectual property law. Sports data is provided by SportsDataIO. Team and league names, logos and marks belong to their respective owners. The Service is not affiliated with, endorsed by or sponsored by the NFL or any team unless stated.
7. Privacy
How we collect and use your information is described in the ACTV8me Privacy Policy, which forms part of these Terms.
8. No warranty
The Service is provided “as is” and “as available”. We do not promise that it will be uninterrupted, error-free or that predictions, scores or data will be accurate or timely. Live sports data can be delayed, corrected or wrong, and settlements may reflect that.
9. Limitation of liability
To the fullest extent permitted by law, ACTV8me and its officers, employees, sponsors and data providers are not liable for any indirect, incidental, special or consequential loss arising from your use of the Service, and our total liability to you for any claim is limited to USD 100. Nothing in these Terms limits liability that cannot be limited by law.
10. Changes and ending the Service
We may change these Terms, and may change, pause or end the Service or any game, at any time. The date at the top of this page shows when the Terms last changed. Continuing to use the Service after a change means you accept the new Terms.
